We gather personal information about you (“Personal Information”) in the following ways:

Information You Provide Directly
When you create an account, use the Services, or otherwise interact with us, we may collect:

  • Account Information: If you subscribe to our free or paid services and create an account, we collect details such as your name, contact details, login credentials, payment information, and your transaction history (collectively, “Account Information”).
  • User Content: Any personal data included in the text, files, images, uploads, or feedback you submit through the Services (“Content”).
  • Communication Information: Your name, contact details, and the contents of any messages you send to us (“Communication Information”).
  • Comments & Voice Notes: If you leave a comment or record a voice note for another user, we store that information (“Communication Information”).
  • Social Media Information: We maintain profiles on platforms such as Instagram, Facebook, Medium, Twitter, YouTube, and LinkedIn. When you interact with those pages, we may collect information you choose to provide, such as contact details (“Social Information”). The platforms may also supply us with aggregated data and analytics about activity on our pages.

Information Collected Automatically When You Use the Services
When you access or engage with the Services, we automatically receive certain information about your use (“Technical Information”), including:

  • Log Data: Details automatically sent by your browser, such as IP address, browser type and settings, date and time of requests, and your interactions with our site.
  • Usage Data: Information about how you use the Services—such as viewed or engaged content, features used, actions taken, time zone, country, session dates and times, device type, and connection details.
  • Device Information: The device name, operating system, browser, and device identifiers. The data collected may vary depending on your device and settings.
  • Cookies: We use cookies to provide, manage, and improve the Services. Cookies are small files sent to your browser by a website. You can configure your browser to accept all, reject all, or notify you of cookies each time. Please note that rejecting cookies may limit certain features or affect the performance of the Services.
  • Analytics: We may also use third-party analytics tools that rely on cookies to help us understand user behavior and improve your overall experience.

2. How We Use Personal Information

We may use your Personal Information for the following purposes:

  • To operate, deliver, manage, and evaluate the Services.
  • To enhance and refine our Services, as well as to support research and development.
  • To communicate with you directly.
  • To design and introduce new programs, tools, or services.
  • To detect, prevent, and address fraud, abuse, or other unlawful activity, and to safeguard the integrity and security of our systems, infrastructure, and networks.
  • To facilitate corporate transactions or business transfers.
  • To comply with legal requirements, regulatory processes, and to defend the rights, property, privacy, or safety of our company, our affiliates, our users, or other parties.

Aggregated and De-Identified Data
We may combine or anonymize Personal Information so that it cannot reasonably be used to identify you. Such data may be used to evaluate the performance of our Services, enhance existing features, introduce new ones, conduct research, or for other similar objectives. We may also study overall user behavior and characteristics and share insights such as usage statistics with third parties, publish reports, or otherwise make aggregated data available publicly. This information may be collected through the Services, cookies, or other methods described in this Privacy Policy. Any de-identified data will be maintained in anonymous form, and we will not attempt to re-identify it unless legally required.

3. Disclosure of Personal Information

In certain situations, we may share your Personal Information with third parties without providing additional notice, unless the law requires otherwise:

  • Vendors and Service Providers: We may share Personal Information with trusted vendors and service providers who support our business operations and deliver specific services on our behalf. This can include hosting providers, cloud platforms, IT service providers, email communication tools, analytics providers, and others. These parties only access, process, or store Personal Information as directed by us and solely for the purpose of carrying out their contractual responsibilities.
  • Business Transactions: If InstantTutor undergoes a strategic transaction, such as a merger, acquisition, restructuring, bankruptcy, receivership, or a transfer of services (collectively, a “Transaction”), your Personal Information, along with other relevant data, may be shared during due diligence or with parties assisting in the process. It may also be transferred to a successor entity or affiliate as part of the assets included in the Transaction.
  • Legal and Compliance: We may disclose your Personal Information, including details of your interactions with our Services, when required by law, or if we reasonably believe it is necessary to:
    • comply with a legal obligation,
    • protect or enforce our rights or property,
    • address a suspected violation of our terms, policies, or applicable law,
    • detect, prevent, or investigate fraud or unlawful activity,
    • ensure the safety, security, and integrity of our products, systems, employees, users, or the general public, or
    • defend against potential legal claims.
  • Affiliates: We may share Personal Information with our affiliates, entities that own, are owned by, or are under common ownership with InstantTutor. Any such use by affiliates will remain consistent with this Privacy Policy.
  • Sharing with Teachers and Schools: By using any of our services and connecting your account with a teache, you give permission for relevant learning data (such as name, class, homework, messages, and progress reports) to be shared with that teacher and the associated school. This sharing happens automatically when you make the connection and allows them to review, support, and monitor learning. You can disconnect or stop sharing at any time in your account settings.

4. Your Rights

Depending on your country or region, such as the EEA, the UK, or elsewhere, you may be entitled to certain legal rights regarding your Personal Information. These rights can include:

A Note on Accuracy

As explained in our Terms of Service, InstantTutor and similar services generate responses by interpreting a user’s input and then predicting the words most likely to follow. This predictive process means that, at times, the output may NOT be factually correct. For that reason, YOU SHOULD NOT TREAT RESPONSES FROM OUR MODELS AS GUARANTEED TO BE ACCURATE or rely on them as a sole source of factual information.

5. Additional Disclosures

The table below outlines further details about the types of Personal Information we collect and how that information may be shared. For more context, see “Personal Information We Collect” above, “How We Use Personal Information” above, and “Security and Retention” below.

Your Rights Over Personal Information

Depending on where you live, and subject to the limits of local law, you may be entitled to certain rights regarding the Personal Information we hold about you. These can include:

  • Access – the ability to request details about how your information is handled, including the specific data we have collected.
  • Erasure – the option to ask us to delete your Personal Information.
  • Correction – the ability to request that we fix or update inaccurate details.
  • Equal Treatment – assurance that you will not be treated unfairly for exercising your privacy rights.

We do not sell Personal Information, nor do we share it for cross-context behavioral advertising, as defined under relevant regulations. We also do not use sensitive categories of data to draw conclusions about an individual’s traits.

How to Submit a Request
If these rights apply to you, you can make a request by emailing data@InstantTutor.app.

Identity Checks
To prevent unauthorized access or misuse of your information, we may need to verify your identity before granting requests to view, amend, or erase data. If you do not have an account with us, or if we detect suspicious activity, we may ask for extra details or proof of residency. Without proper verification, we cannot complete your request.

Requests via Authorized Agents
You may appoint an authorized agent to act on your behalf. The agent will need to provide signed documentation confirming their authority, and in some cases, we may also require you to confirm your identity and residency directly. Requests through agents should be sent to data@InstantTutor.app.

Appeal Process
Some jurisdictions allow you to appeal if you disagree with our response to a privacy rights request. Appeals can be submitted to data@InstantTutor.app.

6. Children

Our Services are not intended for children under 13 years of age, and we do not knowingly collect Personal Information from anyone in this age group. If you believe that a child under 13 has shared Personal Information with us, please contact us at legal@InstantTutor.app. We will review the report and, if confirmed, remove the information from our records.

For users between the ages of 13 and 18, parental or guardian consent is required before using our Services.

7. Links to Other Websites

Our Services may include links to external websites or platforms that are not owned or managed by InstantTutor, such as social media channels (“Third-Party Sites”). Any information you choose to provide on these Third-Party Sites is subject to their own privacy policies and terms of use, not this Privacy Policy.

The presence of these links does not mean we endorse, monitor, or have reviewed the content or practices of those sites. For details on how your information is handled, please reach out directly to the operators of the relevant Third-Party Site.

8. Security and Retention

We use a combination of technical, administrative, and organizational safeguards that are commercially reasonable to protect Personal Information, both online and offline, from loss, misuse, unauthorized access, disclosure, alteration, or destruction. That said, no method of transmitting data over the internet or by email can ever be guaranteed fully secure or error-free. For example, emails you send to or receive from us may not be secure, so please consider carefully the type of information you choose to share in this way. We are also not responsible for any attempts to bypass security features or privacy settings within our Service or on third-party websites.

We keep Personal Information only for as long as necessary to deliver our Services or for other legitimate business purposes, such as meeting legal requirements, ensuring safety and security, or resolving disputes. The exact retention period depends on factors including the type and sensitivity of the data, the potential risk if it were misused, the reasons we collected it, and any applicable laws that require us to keep it for a certain time.

9. International Users

When you use our Services, you acknowledge that your Personal Information may be stored and processed on servers located in the United Kingdom, and may also be shared with affiliates and service providers in other regions.

For users in the EEA, US and Switzerland:

  • Contractual Necessity – We process certain data (such as Account Information, Content, and Technical Information) in order to provide and maintain our Services. Without this information, we may not be able to deliver the Services you have requested.
  • Legitimate Interests – We may process data such as Account Information, Content, Social Information, and Technical Information to prevent fraud, address security risks, protect our Services from misuse, and to improve or promote our offerings.

  • Legal Obligations – We may process or disclose your Personal Information to meet legal requirements, or to safeguard the rights, safety, and property of ourselves, our affiliates, our users, or third parties.

Data Transfers
If Personal Information is transferred outside the EEA, the US, or Switzerland, we will ensure that adequate safeguards are in place and that the transfer complies with applicable data protection laws. We only transfer data when there is a legally valid mechanism to do so. To learn more or request a copy of the safeguards we rely on, please contact legal@InstantTutor.app.
